These terms and conditions apply when you use the Scotch Whisky World website and when you buy from us. Please read them before you place an order: they explain who we are, how we sell to you, how you can cancel or return an order, and what to do if there is a problem. Nothing in them takes away your legal rights as a consumer.

1. Who we are

Scotch Whisky World is a trading name of TVI Fife Limited, a company registered in Scotland with company number SC844459. Our registered office, which is also our address for letters, is 3 Castle Street, Carnegie Campus, Dunfermline, KY11 8PB.

In these terms, "we", "us" and "our" mean TVI Fife Limited, trading as Scotch Whisky World, and "you" means the person using our website or buying from us.

2. These terms

By using our website or placing an order, you agree to these terms. They apply together with our Returns policy, Privacy policy and Cookie policy.

We sell to consumers buying for their own private use. Our products are not for resale.

The terms that apply to an order are the ones on this page when the order was placed. You may wish to keep a copy for your records.

Nothing in these terms affects your legal rights as a consumer. For information about your rights, visit www.citizensadvice.org.uk or, in Scotland, www.consumeradvice.scot.

3. You must be 18 or over

It is against the law to sell alcohol to anyone under 18, and it is an offence to buy alcohol on behalf of someone under 18. By placing an order, you confirm that you are 18 or over and that the alcohol is not for anyone under 18.

Your order must be received by someone aged 18 or over. If they appear to be under 25, they may be asked for photographic proof of age, such as a passport, photocard driving licence or PASS card, and the order may not be handed over without it.

We may cancel an order and refund it in full if we have reason to believe it is being placed by, or for, someone under 18.

4. Using our website

You may use our website to browse and to buy for your own private use. You must not:

  • use it for anything unlawful, fraudulent or harmful, or help anyone else to do so;
  • try to gain unauthorised access to the website, our systems or other people's accounts, or interfere with how the website works or with its security;
  • introduce viruses or any other harmful code;
  • copy, scrape or collect content from the website by automated means, or collect other people's personal information;
  • send spam, or harass, abuse, threaten or discriminate against anyone;
  • give false or misleading information, or pretend to be someone else;
  • copy, reproduce, sell or exploit any part of the website or its content without our written permission.

The website and its content, including its text, photographs, designs and logos, belong to us or to the people who have allowed us to use them. Distillery and brand names belong to their owners and are used only to identify their products.

We work to keep the information on our website accurate and up to date, but it is general information and may change. We may update, suspend or withdraw the website, or any part of it, at any time, for example for maintenance, and we do not promise that it will always be available or free from errors.

5. Your account

You need an account to place an order; if you do not have one yet, you create it as part of checking out. Please keep your sign-in details secure and do not share them, and tell us straight away if you think someone else has used your account.

Please keep your account details, including your e-mail address, delivery address and telephone number, accurate and up to date, so that we can deliver your orders and contact you.

Your orders are kept in your account. You can ask us to close your account at any time from your account page or by contacting us.

6. Our products

We take care to describe and photograph our products accurately. Colours can look different on different screens, and labels and packaging may differ slightly from the pictures when a distillery changes its design.

Whisky is a natural product. Its colour, aroma and taste can vary from one batch to another, and some whiskies develop a slight haze or sediment, particularly when they are cold; this is natural. Tasting notes are a guide and a matter of opinion.

All products are subject to availability. We may limit the quantity of any product that can be bought per person, household or order.

7. Prices and offers

Prices are shown in pounds sterling (£). The price you pay is the price shown when you place your order, plus the delivery charge for the delivery option you choose. The full amount is shown before you pay.

Our prices can change, but a change does not affect an order you have already placed.

Where an offer is shown with an end time, the offer price applies to orders placed before that time.

Despite our care, a product may occasionally be priced wrongly. If the correct price is lower than the price you paid, we will refund the difference. If it is higher, we will contact you before dispatching your order to ask whether you want to go ahead at the correct price or cancel; if we cannot reach you, we will cancel the order and refund you in full. If the mistake was obvious and you could reasonably have recognised it as a mistake, we do not have to supply the product at the wrong price.

8. Placing an order

To order, add products to your basket or use "Buy now", go to the checkout, enter or confirm your details, choose a delivery option and pay. You can check your order and correct any mistakes in it or in your details before you pay. Orders are made in English.

After you place your order, we will e-mail you to acknowledge it. This does not mean that we have accepted it. We accept your order, and a contract is formed between us, when we dispatch it and e-mail you to confirm this.

We may decline or cancel an order before it is dispatched, for example if a product is out of stock, a price was shown in error, we cannot confirm your age, we suspect fraud, we cannot deliver to your address or the order appears to be for resale. If we do, we will tell you and refund everything you paid.

9. Payment

Payment is taken when you place your order. You can pay by debit or credit card or by PayPal, through our payment provider, Cashflows. Card details are entered on Cashflows' secure payment page: we never see or store your full card number or security code.

If your payment is declined, your order is not placed. Refunds are made to the card or account you paid with.

10. Delivery

We deliver to the destinations offered at the checkout. The delivery options, their charges and estimated delivery times are shown at the checkout before you pay.

Delivery times are estimates, and if something delays your order we will let you know. If we have not delivered your order within 30 days of accepting it, or by any delivery date we agreed with you, you can cancel it and receive a full refund.

Someone aged 18 or over must receive your order and may be asked for proof of age (see section 3). If nobody is available, please follow the delivery company's instructions to arrange another delivery. If a parcel is returned to us because it could not be delivered, we will contact you to arrange another delivery or a refund.

Your order is our responsibility until it is delivered to you, or to someone you have nominated. It becomes yours once it has been delivered and we have received full payment.

Please check your order when it arrives and tell us within 48 hours if anything is missing or damaged (see section 12). This does not affect your legal rights.

11. Cancelling your order and returns

You can cancel your order for any reason within 14 days, starting the day after it is delivered, and receive a full refund of the price and the standard delivery charge, as long as the bottles are returned sealed and unopened. You pay the cost of sending them back, unless they are faulty or not what you ordered.

Our Returns policy explains how to cancel, how to return bottles and how refunds work, and includes a cancellation form you can use.

12. If something is wrong with your order

The law says that the goods we sell you must be as described, of satisfactory quality and fit for purpose. If a bottle arrives broken, leaking, faulty or not as described, or you receive the wrong item, please contact us with your order number and, if you can, photographs of the bottle and its packaging. We will arrange its return at our cost and replace it or refund you in full, including delivery.

Under the Consumer Rights Act 2015, if goods are faulty you can reject them for a full refund within 30 days of delivery; after that, you can ask for a repair or replacement and, if that is not possible or does not solve the problem, a refund or a price reduction. This is in addition to your right to cancel (section 11).

13. Our responsibility to you

If we fail to keep to these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or of our failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.

We supply our products for private use only. We are not responsible to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

Nothing in these terms limits or excludes our responsibility for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breaking your legal rights in relation to the products (including your right to receive products that are as described, of satisfactory quality and fit for purpose), or for anything else that the law does not allow us to limit or exclude.

We take reasonable care to keep our website secure, but we cannot promise that it will always be free from viruses or other harmful code, so please use your own virus protection.

14. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, strikes, failures of transport or communication networks, or actions of government. If such an event affects your order, we will tell you as soon as we can and do what we reasonably can to limit the delay. If there is a risk of a substantial delay, you can cancel your order and receive a refund for anything you have paid for and not received.

15. Other websites and services

Our website may link to other websites, and some services, such as the secure payment page, are provided by other companies under their own terms. We do not control other websites and are not responsible for their content or for how they use your information, so please read their own terms and policies.

16. Reviews, comments and feedback

If you send us reviews, comments, suggestions or other material, you allow us to use, edit and publish them in connection with our business, without payment. You must not send anything unlawful, defamatory, offensive or obscene, anything that infringes someone else's rights or anything containing viruses, and you must not pretend to be someone else. We may remove any material that breaks these rules.

17. Your personal information

We will only use your personal information as set out in our Privacy policy and Cookie policy.

18. Suspending or closing an account

You can stop using our website and ask us to close your account at any time. We may suspend or close your account, or refuse to accept orders from you, if we reasonably believe that you have broken these terms or the law, for example by buying alcohol for someone under 18 or by misusing the website. If we do, we will refund any order that we have not delivered.

19. Complaints

If you have a complaint, please contact us first, giving your order number if you have one. We aim to reply within five working days and to resolve every complaint as quickly as we can.

20. Other important terms

We may transfer our rights and obligations under these terms to another organisation, for example if we sell our business. We will tell you if this happens, and it will not affect your rights. You may only transfer your rights or obligations under these terms to someone else if we agree in writing.

No one other than you and us has any right to enforce these terms.

Each paragraph of these terms operates separately. If a court decides that any of them is unlawful, the rest will remain in full force.

If we do not insist straight away that you do something you are required to do under these terms, or if we delay taking steps against you, that does not mean that we cannot do so later.

21. Which laws apply

These terms are governed by Scots law. You can bring legal proceedings about our products or these terms in the Scottish courts. If you live in England or Wales, you can also bring them in the courts of England and Wales, and if you live in Northern Ireland, in the courts of Northern Ireland.

22. Changes to these terms

We may change these terms from time to time, for example to reflect changes in the law or in how we run the shop. The version on this page applies to orders placed from the date at the top; an order you placed earlier stays under the terms that applied when you placed it.
